1. About FeasibilityLab
FeasibilityLab is a trading name operated by an individual sole trader established and operating in England and Wales. Correspondence address: 55 Percival Road, Enfield, EN1 1QS, England. Contact email: hello@feasibilitylab.co.uk. We do not have a dedicated telephone line; please contact us by email.
FeasibilityLab provides a free online planning trigger tool and, separately, auto-generated PDF guidance documents for residential planning and building regulations in England. These terms govern your use of both.
2. Definitions
- FeasibilityLab: the business and its website at feasibilitylab.co.uk.
- Free Tool: the planning trigger tool available without registration or payment.
- Guidance Document: a PDF guidance document purchased via the website.
- Project Information: the information you enter into the tool to generate a result or guidance document.
- Consumer: a natural person using the service for purposes outside their trade, business, or profession.
- Business Customer: a person or entity using the service for purposes related to their trade, business, or profession.
3. The Free Tool
The free tool assesses whether a proposed residential project in England is likely to require planning permission, based on the General Permitted Development Order 2015 and current planning policy. Results are indicative only and do not constitute a formal determination by any planning authority. Results are provided free of charge and without registration.
4. Guidance Documents
Guidance documents are auto-generated PDFs produced from the Project Information you provide. Four types are available: Full Planning Permission (£35), Prior Approval (£17), Building Regulations (£17), and Edge Case Assessment (£17). Prices shown are the full price inclusive of all charges. FeasibilityLab is not VAT-registered; no VAT is charged.
A contract is formed between you and FeasibilityLab at the point your payment is confirmed by Stripe. Guidance documents are generated and delivered instantly after payment is confirmed. They are specific to the Project Information provided and cannot be amended after generation.
Format and compatibility: Guidance documents are delivered as PDF files. They can be opened on any device with a PDF reader (including Adobe Acrobat Reader, Apple Preview, and browser-based PDF viewers). No specific operating system is required. Each document is generated once and is not updated if legislation or planning policy changes after the date of generation. The document does not connect to, or interoperate with, any other software or system. No digital rights management (DRM) is applied.
5. Acceptable Use
You agree not to: (a) use automated means to access or scrape the website or free tool; (b) deliberately submit false or misleading Project Information; (c) attempt to reverse-engineer, decompile, or extract the logic underlying the tool or document generation; or (d) use the website in any way that could damage, disable, or impair its operation or interfere with other users.
6. Accuracy
The accuracy of any result or guidance document depends on two separate factors, which are treated differently:
- Your Project Information: You are responsible for ensuring all information you enter is correct and complete. FeasibilityLab is not liable for results or guidance generated from inaccurate or incomplete Project Information provided by you.
- Our generation system: Where a document contains an error attributable to a fault in our generation system rather than your Project Information — for example, an incorrect rule being applied to correct inputs — your rights under Section 9 (Consumer Remedies) apply and we will provide a corrected document or appropriate refund.
Each guidance document is generated against the legislation and planning policy current at the date of generation. FeasibilityLab is not liable for changes to the General Permitted Development Order, the National Planning Policy Framework, or other legislation or policy that occur after the date of generation.
7. No Professional Advice
FeasibilityLab is not a planning consultancy, architect, or legal adviser. The free tool and guidance documents are informational resources only. They do not constitute professional planning advice, legal advice, or a formal determination of planning law. They do not create any advisory relationship between FeasibilityLab and the user.
In particular, guidance documents are not:
- —A Lawful Development Certificate (LDC) issued by a Local Planning Authority
- —A Prior Approval determination by a Local Planning Authority
- —A formal legal opinion on whether planning permission is required
- —Admissible evidence in any planning enforcement proceedings
You should seek advice from a qualified planning consultant, architect, or solicitor before proceeding with works where there is any doubt, and in particular where your project involves any of the following:
- —Listed buildings or buildings in conservation areas
- —Land in an Area of Outstanding Natural Beauty, National Park, or World Heritage Site
- —Article 4 Directions removing permitted development rights
- —Conditions on existing planning permissions restricting permitted development
- —Structural alterations or works affecting party walls
- —Any project where enforcement action has previously been threatened or taken
- —Any uncertainty about the boundaries, use class, or planning history of the property
8. Consumer Cancellation Rights
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers normally have a 14-day right to cancel purchases of digital content. However, under Regulation 37, you lose this right once delivery of the digital content has begun, provided you have given prior express consent to immediate delivery and acknowledged that you thereby lose your cancellation right.
By completing your purchase, you confirm — via the checkbox provided before payment — that you consent to immediate delivery of your guidance document and acknowledge that you will lose your right to cancel once delivery has begun. Delivery begins immediately upon payment confirmation.
Where the cancellation right would otherwise apply (for example, if delivery has not yet begun), you may cancel by contacting hello@feasibilitylab.co.uk with your order reference. A model cancellation form is available from the European Consumer Centre (Schedule 3 of the Regulations); contact us and we will provide it on request.
This clause does not affect your statutory rights under the Consumer Rights Act 2015 in respect of digital content that is not of satisfactory quality, not fit for purpose, or not as described.
9. Your Rights as a Consumer — Digital Content Remedies
Under the Consumer Rights Act 2015, digital content must be of satisfactory quality, fit for purpose, and as described. If a guidance document you have purchased does not meet these standards, you have the following remedies:
- Repair or replacement: We will correct or replace the document at no cost to you and within a reasonable time, without causing you significant inconvenience. This is your primary remedy under the Act.
- Price reduction or refund: If repair or replacement is impossible, disproportionately costly, or has not been done within a reasonable time, you may be entitled to a price reduction or a full refund.
To invoke these rights, contact hello@feasibilitylab.co.uk with your order reference and a description of the issue. We will respond within 5 working days.
10. Refunds
Outside of your statutory rights under Section 9, no refunds are available once a guidance document has been generated and delivered. A review screen is provided before payment so you can verify your answers before proceeding.
If you experience a technical failure that prevents download, contact hello@feasibilitylab.co.uk within 24 hours and we will arrange redelivery.
11. Limitation of Liability
To the extent permitted by law, FeasibilityLab's total liability to any user in connection with any guidance document is limited to the purchase price paid for that document. FeasibilityLab is not liable for any indirect, consequential, or economic loss arising from use of the tool or guidance documents.
Nothing in these terms excludes or limits liability for: death or personal injury caused by negligence; fraudulent misrepresentation; or any other liability that cannot be excluded or restricted by law.
If you are a Consumer, this limitation of liability does not affect your statutory rights under the Consumer Rights Act 2015.
12. Intellectual Property
FeasibilityLab grants you a non-exclusive, non-transferable licence to use any purchased guidance document for your personal or business use in connection with the property described in the Project Information. You may share the document with professionals working on your project. You may not resell, sub-licence, or publish the document or any part of it.
13. Data Protection
Your personal data is processed in accordance with our Privacy Policy. Payment data is processed by Stripe and is not stored by FeasibilityLab.
14. Force Majeure
FeasibilityLab will not be liable for any delay or failure to perform its obligations under these terms where such failure results from causes beyond its reasonable control, including (without limitation) failures of third-party infrastructure (including Stripe or Netlify), internet outages, acts of government, or natural disasters. Where such an event prevents delivery of a purchased guidance document, FeasibilityLab will use reasonable endeavours to deliver as soon as practicable. If delivery cannot be completed within 7 days, a full refund will be offered.
15. Website Availability
FeasibilityLab does not guarantee that the website will be available at all times or free from errors. Access may be suspended temporarily for maintenance or due to circumstances outside our control. Where a service interruption affects your ability to access a purchased guidance document, contact hello@feasibilitylab.co.uk and we will arrange redelivery or a refund as appropriate.
16. Complaints and Dispute Resolution
If you have a complaint, please contact us in the first instance at hello@feasibilitylab.co.uk. We will aim to respond within 5 working days.
We are not currently signed up to an Alternative Dispute Resolution (ADR) scheme and are not obliged to use one. If we are unable to resolve your complaint, you may wish to seek independent legal advice or contact the Citizens Advice consumer helpline on 0808 223 1133 (free, Monday to Friday 9am–5pm).
17. Changes to These Terms
We may update these terms from time to time. Changes will be published on this page with an updated "Last updated" date. Changes do not affect contracts already formed at the date of the change. Continued use of the website after updated terms are published constitutes acceptance of the updated terms for any new purchases. Where we make material changes — such as changes to pricing, liability, or your consumer rights — we will also notify you by email where we hold a valid email address.
18. General
Entire agreement. These terms constitute the entire agreement between you and FeasibilityLab in relation to their subject matter and supersede all prior representations, agreements, or understandings, whether written or oral. Nothing in this clause limits liability for fraudulent misrepresentation.
Severability. If any provision of these terms is found by a court of competent jurisdiction to be invalid, unenforceable, or illegal, the remaining provisions will continue in full force and effect.
Waiver. No failure or delay by FeasibilityLab in exercising any right under these terms will constitute a waiver of that right. No waiver of any breach will be construed as a waiver of any subsequent breach.
Assignment. FeasibilityLab may assign or transfer its rights and obligations under these terms to a successor business without your consent, provided your rights are not materially affected. You may not assign or transfer your rights under these terms without our prior written consent.
Third-party rights. These terms do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 for any third party to enforce any term of these terms.
19. Governing Law
These terms are governed by the law of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.
